Will and Trusts Contests

When a parent, spouse or sibling passes away, it is not unusual for family members to get involved in a dispute over the validity of a will or trust. Wills and trusts may be challenged on a variety of legal grounds, including:

  • Undue influence: A child, sibling, friend, caregiver or other individual may have engaged in undue influence over a decedent prior to his or her death, especially in cases in which the decedent was suffering from Alzheimer's or dementia, or in a weakened mental condition or state of diminished mental capacity.
  • Lack of capacity: A person must be of sound mind when he or she executes a will or trust. A will or trust may be challenged for lack of capacity if it is determined that, at the time the testator executed the instrument, he or she did not have sufficient mental capacity to make a fully informed decision about his or her estate.
  • Lack of proper execution: A will must be properly executed. If the will was not properly signed and witness, or if other fatal defects exist, the will may be subject to challenge for lack of proper execution.

Trust Disputes

Trustees have a fiduciary duty to trust beneficiaries.
